1. About these Terms and the parties

These Terms & Conditions (the "Terms") govern your access to and use of the website located at https://thecrewatelier.com and its subdomains (the "Website"), and every service, digital product, consultation, download, communication channel, WhatsApp support, and concierge offering supplied by The Crew Atelier (together, the "Services").

The Crew Atelier is operated by [The Crew Atelier OÜ], a company registered in Estonia under registration number [to be inserted], with registered office at [registered office address, Tallinn, Estonia] ("The Crew Atelier", "we", "us", "our"). The Crew Atelier is an independent yacht career concierge and career-intelligence company. It is not a recruitment agency, employment agency, yacht management company, training provider, visa agency, immigration consultancy, legal practice or educational institution.

By accessing the Website, creating an account, submitting an enquiry, purchasing a Service, downloading a digital product, engaging in a consultation, joining a WhatsApp group or otherwise interacting with us, you confirm that you have read, understood and agreed to be bound by these Terms and by every policy incorporated by reference — including the Privacy Policy, Cookie Policy, Refund & Cancellation Policy, General Disclaimer, Consultation & Concierge Terms, Digital Products Terms, Sponsorship Terms, Referral & Promotional Code Terms and Legal Notice. If you do not agree, you must stop using the Website and Services immediately.

We may update these Terms at any time. The version in force is the one published on the Website at the moment you place an order or use the Services. Material changes are notified by updating the "Updated" date at the top of this page and, where the change materially affects your rights, by email to registered account holders.

2. What The Crew Atelier does and does not do

We provide independent career-intelligence, coaching, editorial, guidance and concierge services to individuals pursuing careers on private and commercial yachts, and to the parents and families supporting them. We share opinions, comparisons, checklists, contacts and structured guidance drawn from lived industry experience and continuous market research.

We provide, among other things:

  • personalised Career Roadmap documents (paid);
  • CV creation, CV review and CV editing services;
  • Discovery Calls, 1-hour and 2-hour onboarding calls, mentorship calls and follow-up calls;
  • Premium Concierge and Diamond All-Inclusive packages;
  • dedicated parent and family consultations and packages;
  • training-course comparisons, honest opinions on schools and course-booking assistance;
  • visa research, checklists and coordination guidance;
  • accommodation and travel coordination assistance;
  • WhatsApp support during agreed engagement periods;
  • downloadable digital products (PDF guides, templates, worksheets);
  • the Pay It Forward sponsorship programme;
  • the referral and promotional discount programme;
  • editorial content, industry insights and multilingual Website content.

We do NOT, under any circumstance, provide:

  • recruitment, placement or employment services — we are not an employment or recruitment agency and we do not source, screen, present or place crew for any yacht, captain, management company, agency or owner;
  • an employment relationship with any yacht, captain, owner or management company on your behalf;
  • yacht management, chartering, brokerage or crewing-agency services;
  • regulated training, examinations, certifications or licences — we are not an accredited training provider or examining body;
  • regulated immigration or visa services — we are not a licensed immigration adviser or visa agent, and any information we provide is general guidance only;
  • legal advice, tax advice, financial advice, medical advice or regulated professional advice of any kind;
  • academic degrees, diplomas or recognised educational qualifications;
  • guaranteed outcomes of any nature (see clause 12).

The scope of any specific Service is defined in that Service's product page, checkout summary, intake form or written engagement confirmation. Where scope differs between documents, the checkout summary and any written scope confirmation prevail.

3. Eligibility and account use

You must be at least 18 years old to purchase Services in your own name. Where a Service is purchased for the benefit of a minor (for example, a parent commissioning a Roadmap for a child aged 16 or 17), the purchasing adult remains the contracting party, is responsible for all obligations under these Terms, and warrants that they have parental authority to disclose the minor's personal data to us for the purpose of delivering the Service.

You warrant that all information you supply to us — during enquiry, checkout, intake, consultation, document upload or otherwise — is true, complete, accurate, lawful for you to share, and kept up to date. You are solely responsible for keeping any account credentials confidential and for all activity conducted through your account or via the email address you register with us.

We may refuse, suspend, terminate or restrict access to any Service or the Website at our sole discretion where we have reasonable grounds to believe there has been misuse, fraud, chargeback abuse, illegal activity, misrepresentation, harassment of our team, breach of these Terms, or where continued provision would cause material harm to us or a third party.

4. Ordering, formation of contract and pricing

Placing an order via the Website checkout, an intake form, a confirmed invoice, a WhatsApp confirmation, or an email accepting a written quote constitutes an offer to purchase the relevant Service on these Terms. A contract is formed only once we send you a written order confirmation or the Service is otherwise delivered to you.

Prices are displayed on the Website in Euro (€) unless otherwise indicated and are inclusive of any applicable value-added tax (VAT) at the standard rate. Where a Service is delivered to a jurisdiction where a different tax treatment applies, we will adjust and disclose the tax at checkout in accordance with the applicable law.

Featured retail prices for standard Services at the date of publication include (subject to change): Career Roadmap €89; CV Creation €75; CV Review; Discovery Call (free 15 minutes); 1-hour Onboarding Call; 2-hour Onboarding Call; Starter package €299; Career Launch €599; Premium Concierge €1,200; Parents Starter €99; Parents Standard €249; Parents Premium €699; Diamond All-Inclusive €5,950. Additional CV revisions beyond the three included revisions are billed at €5 per additional revision. The definitive price for your order is the price shown at checkout.

We reserve the right to correct pricing errors before your order is confirmed. Where a pricing error is discovered after confirmation, we will contact you, offer to reconfirm at the corrected price, or cancel the order and refund any amount paid.

5. Payment and invoicing

Payments are collected through Stripe Payments Europe, Ltd. and its affiliates (the "Payment Processor"). By purchasing a Service you also agree to the Payment Processor's own terms of service and privacy policy. We do not store your full payment-card number; we receive only tokenised references and truncated card metadata to reconcile receipts.

Unless a written engagement letter states otherwise, all Services are payable in full in advance. Instalment plans, deposits and split payments are available only where expressly offered at checkout or in a written engagement letter, and are governed by the schedule stated there.

If a payment is refused, reversed, charged back, or otherwise fails, we may suspend delivery, withdraw any partially delivered Service, deactivate access to any digital product, and charge you reasonable administrative costs and any bank or processor fees actually incurred.

6. Delivery, timelines and client responsibilities

Delivery times published on the Website are estimates in working days (Monday to Friday, excluding Estonian and European public holidays). Delivery clocks start once we have received (i) cleared payment, (ii) a completed intake form and (iii) every document, photograph, questionnaire response, translation or clarification we reasonably request.

You are responsible for supplying legible, accurate and complete information promptly, for responding to our clarifying questions within a reasonable time, and for attending scheduled calls at the agreed time using a stable internet connection and quiet environment. Where you fail to do so, delivery may be delayed and — for time-bound Services (e.g. calls, live sessions) — the Service may be treated as delivered.

Where an intake, upload or coordination step requires input from a third party you have introduced (for example, a captain, school, medical examiner or embassy), we are not responsible for that third party's delay, refusal or errors.

7. Consultations, calls and concierge engagements

Detailed rules for consultations, coaching calls, onboarding calls, concierge engagements, WhatsApp support windows and rescheduling are set out in the Consultation & Concierge Terms, which form part of these Terms.

8. Digital products and downloads

Detailed rules for downloadable PDFs, templates, worksheets and personalised Career Roadmaps — including licence scope, permitted use, immediate-performance withdrawal waivers and access windows — are set out in the Digital Products Terms, which form part of these Terms.

9. Refunds, cancellations and consumer withdrawal rights

Refund and cancellation rights, including the 14-day EU distance-selling right of withdrawal and the express waivers that apply to immediately-performed digital services, are set out in the Refund & Cancellation Policy, which forms part of these Terms.

10. Intellectual property

All content on the Website and in our deliverables — including text, editorial, roadmaps, templates, checklists, CV frameworks, artwork, photography, video, code, brand marks, logos, translations, curated data and course comparisons — is owned by or licensed to The Crew Atelier and is protected by copyright, database, trade-mark and other intellectual-property rights.

On full payment, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the deliverable produced for you (for example, your personalised Career Roadmap or CV) solely for your own personal, non-commercial career purposes. You may not resell, sublicense, republish, distribute, translate, or use our deliverables to build a competing product or a training programme, and you may not remove any credit or watermark.

You retain ownership of the personal information and source documents you provide to us. You grant us a worldwide, royalty-free, non-exclusive licence to use, store, process, translate and adapt those materials solely to deliver, improve and support the Services you have purchased and to comply with our legal obligations.

Testimonials, quotations, review screenshots and success stories may be used by us in anonymised form unless you have provided express written consent for attribution. You may withdraw consent at any time by writing to concierge@thecrewatelier.com; we will remove the material from active use within a reasonable period but are not obliged to alter historic archives, printed materials or third-party caches.

11. Acceptable use of the Website and Services

You agree that you will not:

  • use the Website or Services for any unlawful, fraudulent, deceptive or misleading purpose;
  • submit false, forged, altered or misleading documents (passports, ENG1s, references, discharge books, certificates);
  • impersonate any person or misrepresent your affiliation with any yacht, captain or company;
  • harass, threaten, insult, discriminate against or otherwise abuse our team, our contractors, or other clients;
  • attempt to gain unauthorised access to the Website, our systems, another user's account, or any connected service;
  • scrape, harvest, mirror, resell or systematically reproduce Website content, course comparisons or contact data;
  • upload viruses, malware, illegal content, sexually explicit content or content that infringes another person's rights;
  • resell, share, sublicense or expose access to WhatsApp groups, digital products or subscription content;
  • use the Website or Services in breach of any applicable export-control, sanctions, anti-money-laundering or anti-terrorism law.

12. No guarantees — career, recruitment, visa, training, medical

The yachting industry is competitive, seasonal and driven by many factors outside our control, including your own effort, experience, appearance, references, personality fit, timing, market conditions, geopolitics, port-state control, weather, and captain and owner preferences. Accordingly, and without limitation, we make no representation, warranty or guarantee that you will:

  • be hired, offered a dayworker slot, offered a green-crew position, promoted or retained on any yacht;
  • be introduced, referred, presented, shortlisted or recommended to any captain, agency, owner or crew agent;
  • obtain any visa, residence permit, seafarer's discharge book, seaman's book, endorsement or right to work;
  • pass any course, examination, ENG1 medical, drug test or interview;
  • achieve any specific salary, tip level, itinerary, boat size, department or contract length;
  • earn back your investment in training, travel, accommodation or our Services.

Our Services are guidance and support Services. Any decision you take — including whether to travel, undertake courses, accept employment or spend money on any third-party product — is your own decision, taken at your own risk and expense. Additional disclaimers are set out in the General Disclaimer.

13. Third-party providers and platforms

The Services rely on third-party providers, including but not limited to Stripe (payments), Cal.com (booking), WhatsApp (messaging), our email service provider (transactional and marketing email), our hosting and analytics providers, our document-storage provider, translation providers and third-party training schools. We select these providers carefully but are not responsible for their independent acts, omissions, outages, price changes or policy changes. Your use of any third-party platform is subject to that platform's own terms.

Recommendations, comparisons, opinions and links relating to training schools, agencies, apps, service providers, embassies, airlines, accommodation providers and yachts are provided in good faith for information only. We do not receive undisclosed commissions from schools; where we ever earn a referral fee, we will state so on the relevant page.

14. Limitation of liability

Nothing in these Terms limits or excludes any liability which cannot lawfully be limited or excluded, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for consumers' statutory rights that cannot be waived under mandatory law.

Subject to the paragraph above, and to the maximum extent permitted by applicable law:

  • our total aggregate liability to you arising out of or in connection with a Service is capped at the total fees actually paid by you to us for that Service in the twelve (12) months preceding the event giving rise to the claim;
  • we exclude all liability for indirect, consequential, special, incidental, punitive or exemplary loss, loss of profits, loss of business, loss of opportunity, loss of employment, loss of goodwill, loss of reputation, loss of anticipated savings, loss of chance, wasted expenditure, loss caused by third parties, and loss of or damage to data;
  • we exclude all liability for outcomes referenced in clause 12 (no guarantees).

15. Indemnity

You agree to indemnify, defend and hold harmless The Crew Atelier, its owners, employees, contractors, agents and affiliates from and against all claims, damages, losses, costs and reasonable legal fees arising out of (i) your breach of these Terms, (ii) your infringement of any third-party right, (iii) any content you submit to us, (iv) any misrepresentation you make to us or through Services we deliver on your instruction, or (v) your unlawful conduct.

16. Suspension and termination

We may suspend or terminate your access to any or all Services immediately, without refund and without prejudice to any other remedy, where you have materially breached these Terms, engaged in fraud or chargeback abuse, misrepresented facts, submitted falsified documents, harassed our team, or where continued provision is unlawful or commercially unreasonable. You may terminate an engagement in accordance with the Refund & Cancellation Policy.

17. Force majeure

We are not liable for any failure to perform or delay in performance caused by an event beyond our reasonable control, including natural disasters, extreme weather, pandemics, epidemics, war, armed conflict, terrorism, cyber-attack, industrial action, government act, sanctions, port-state action, embassy closures, third-party platform outages, internet outages, and disruption to our staff. Where such an event continues for more than sixty (60) days, either party may terminate the affected engagement and we will refund any fees paid for Services not yet delivered.

18. Privacy and data protection

Our processing of your personal data is described in the Privacy Policy and the Cookie Policy, each of which forms part of these Terms.

19. Complaints and dispute resolution

If you are unhappy with any aspect of the Services, please email concierge@thecrewatelier.com within a reasonable time so we can attempt to resolve the matter directly. If we cannot resolve the matter within thirty (30) days, EU-resident consumers may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

20. Governing law and jurisdiction

These Terms and any non-contractual obligations arising out of them are governed by the laws of the Republic of Estonia. Subject to any mandatory consumer-protection rules that entitle you to bring proceedings in the courts of your country of residence, the courts of Harju County, Estonia have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.

21. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force. No failure or delay in enforcing a right is a waiver. You may not assign or transfer your rights under these Terms without our written consent; we may assign these Terms to an affiliate or successor in connection with a corporate reorganisation. These Terms, together with the documents incorporated by reference, constitute the entire agreement between you and us in relation to the Services.
